These Terms of Service (“Terms”) govern your access to and use of the Hubb Serve website, community features, Hobbyist Profiles, Hubb pages, directories, content, services, and other features made available by Hubb Serve LLC (“Hubb Serve,” “Company,” “we,” “our,” or “us”).

By accessing or using Hubb Serve, creating an account or profile, submitting content, participating in a community, or using any Hubb Serve service, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

If you do not agree with these Terms, you should not use the website or its services.

1. About Hubb Serve

Hubb Serve is an online platform designed to help people discover and connect with hobbies, interests, sports, activities, creators, hobbyists, communities, products, services, educational resources, social media content, and other related information.

Hubb Serve may provide or facilitate access to:

hobby and interest information;
Hobbyist Profiles and featured profiles;
community boards and community features;
links to creators, hobbyists, social media accounts, websites, videos, tutorials, and other resources;
product, equipment, supply, class, and service recommendations;
affiliate links;
member-created pages or “Hubbs”;
content creation, website, technology, marketing, or profile-management services;
sponsored or promotional content; and
other services or features made available by Hubb Serve from time to time.

Hubb Serve may add, modify, suspend, or discontinue features or services at any time.

2. Eligibility and Website Use

The Hubb Serve website, including its account, membership, profile, community, content, and service features, is intended for use by adults.

By accessing or using Hubb Serve, creating an account, submitting content, creating or managing a Hobbyist Profile, participating in community features, or using any Hubb Serve service, you affirm that you are at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater, that you have the legal capacity to enter into a binding agreement, and that you have read, understood, and agreed to these Terms of Service and the Hubb Serve Privacy Policy.

Visitors may browse publicly available portions of Hubb Serve without creating an account; however, certain features may require registration, membership, or other eligibility requirements. All use of Hubb Serve must be lawful and consistent with these Terms.

Individuals under the age of 18 may not independently create, register for, own, or manage a Hubb Serve account, membership, Hobbyist Profile, community profile, or other account-based feature.

Hubb Serve may permit profiles, pages, photographs, videos, accomplishments, sports-related information, hobby content, or other materials that feature minors when such content is created, authorized, submitted, and managed by the minor’s parent or legal guardian in accordance with these Terms and the Hubb Serve Privacy Policy. A minor who appears in or is the subject of such content is not considered the account holder or registered user.

Content Directed to Parents and Adults

Content, product recommendations, promotions, and affiliate links involving children or products intended for children must be directed to parents, legal guardians, or other adult decision-makers, not directly to children under 13.

Users may not use Hubb Serve to directly encourage children under 13 to make or influence a purchase. Calls to action and affiliate promotions must clearly address the adult responsible for evaluating or purchasing the product or service.

Permitted: “Parents looking for gifts may want to consider this product.”

Not Permitted: “Kids, ask your parents to buy this now!”

Hubb Serve may remove or restrict content or affiliate links that it reasonably determines are improperly directed toward children.

3. Accounts and Member Information

When creating an account, profile, community membership, or other Hubb Serve registration, you agree to provide accurate and current information.

You are responsible for:

maintaining the confidentiality of your login credentials;
restricting unauthorized access to your account;
activity conducted through your account;
keeping your contact information current; and
notifying Hubb Serve if you believe your account has been compromised.

You may not impersonate another individual or organization or create an account using information that you do not have permission to use.

Hubb Serve may require additional verification when necessary to protect users, children, content owners, the community, or the integrity of the platform.

4. Hobbyist Profiles and Member Content

Hubb Serve may allow eligible users to create Hobbyist Profiles, member pages, featured profiles, community posts, links, recommendations, biographies, photographs, videos, descriptions, and other content.

You are responsible for all information and content that you submit.

By submitting content, you represent that:

you own the content or have permission to submit it;
the information you provide is accurate to the best of your knowledge;
your submission does not violate another person's intellectual property, privacy, publicity, or other legal rights;
your submission does not contain unlawful, fraudulent, deceptive, threatening, abusive, or malicious material; and
you have obtained any permissions necessary for individuals appearing in photographs, videos, or other submitted material.

Hubb Serve does not guarantee that submitted profiles or content will be published or remain available.

5. License for User-Submitted Content

You retain ownership of content that you own and submit to Hubb Serve.

By submitting content for publication or display through Hubb Serve, you grant Hubb Serve a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, resize, display, publish, distribute, and otherwise use that content as reasonably necessary to operate, promote, and provide the Hubb Serve website and services.

This license includes the ability to display submitted content on Hubb Serve websites, Hubb pages, social media channels, promotional materials, search results, directories, newsletters, and related digital properties.

You represent that you have the authority to grant this license.

Except where otherwise agreed in writing, this license ends when the applicable content is permanently removed from Hubb Serve's systems, except for reasonable backup copies, previously distributed promotional material, legal recordkeeping, or materials that Hubb Serve has an independent legal right to retain.

6. Children Under 13

Hubb Serve places additional restrictions on accounts, profiles, content, and community activity involving children under the age of 13.

Children under 13 may not independently create, register for, own, submit to, or manage a Hubb Serve account, membership, community profile, Hobbyist Profile, or other account-based feature.

Any profile or content highlighting the hobbies, interests, sports, creative activities, accomplishments, or activities of a child under 13 must be created, authorized, submitted, and managed by the child’s parent or legal guardian. The parent or legal guardian is responsible for the account, all submitted content, and ensuring that the information shared complies with these Terms and the Hubb Serve Privacy Policy.

Users may not publish or submit personally identifiable or sensitive information about a child under 13 unless specifically permitted by Hubb Serve. Prohibited information includes information that could reasonably identify, locate, contact, or create a privacy or safety risk for the child, including a child’s:

home address or precise location;
personal telephone number or email address;
school name, classroom, or detailed school schedule;
financial, medical, or other sensitive personal information; or
other information that could reasonably be used to identify or locate the child outside the context of the approved profile.

Content may include a child’s first name, general hobby or sport, accomplishments, photographs, videos, or similar information only when submitted or authorized by the parent or legal guardian and otherwise permitted by Hubb Serve.

External links associated with a profile featuring a child under 13 must be submitted and controlled by the parent or legal guardian and must not direct users to content that exposes prohibited personal information or creates an unreasonable privacy or safety risk.

Content, product recommendations, promotions, and affiliate links relating to children or products intended for children must be directed to parents, legal guardians, or other adult decision-makers, and not directly marketed to children under 13.

Hubb Serve reserves the right to review profiles, content, photographs, videos, external links, affiliate links, and other information involving children and may edit, restrict, disable, or remove material that violates these requirements or otherwise creates a privacy, safety, legal, or security concern.

Hubb Serve may also request reasonable verification of parental or legal guardian authority and may suspend or remove profiles or accounts when appropriate to protect children or enforce these Terms.

Safety Review

Hubb Serve reserves the right to review profiles, external links, social media links, images, descriptions, and other submitted information involving minors to help confirm compliance with Hubb Serve's child-safety and privacy requirements.

Hubb Serve may:

request verification of parental or legal guardian authority;
reject or remove content;
disable external links;
restrict community functionality;
suspend or terminate accounts;
preserve information when reasonably necessary for investigation or legal compliance; and
report suspected exploitation, abuse, unlawful conduct, or other serious safety concerns to appropriate platforms, service providers, or authorities when warranted or legally required.

Submission or publication of a profile does not limit Hubb Serve's ability to conduct later reviews or remove content.

7. Community Standards and Prohibited Conduct

You agree not to use Hubb Serve to:

violate any applicable law or regulation;
harass, threaten, abuse, exploit, stalk, or intimidate another person;
exploit or endanger a child;
publish inappropriate personal information about a minor;
impersonate another person or organization;
make fraudulent or intentionally misleading representations;
distribute spam or unauthorized advertising;
upload malware, viruses, malicious code, or harmful software;
interfere with the security or operation of Hubb Serve;
attempt unauthorized access to accounts, servers, systems, or data;
scrape, harvest, extract, or systematically collect Hubb Serve content or user information without authorization;
circumvent security or access restrictions;
violate copyrights, trademarks, privacy rights, publicity rights, or other intellectual property rights;
use Hubb Serve to promote illegal products, services, activities, or transactions;
manipulate reviews, recommendations, engagement, or community activity;
use automated tools to create accounts or submit content without authorization; or
engage in conduct that Hubb Serve reasonably determines could endanger users or damage the platform or its community.

Hubb Serve may investigate potential violations and take appropriate action.

8. Hubb Serve Intellectual Property

Except for content owned by users, licensors, partners, or third parties, the Hubb Serve website and its original content, branding, design, logos, graphics, software, databases, organization, and other materials are owned by or licensed to Hubb Serve LLC and may be protected by copyright, trademark, and other intellectual property laws.

This may include names and branding such as:

Hubb Serve, HubbServe, related Hubb branding, logos, designs, page formats, and other Hubb Serve properties.

Permission to use the website does not transfer ownership of Hubb Serve intellectual property.

Unless authorized in writing, you may not reproduce, sell, license, modify, republish, create derivative commercial products from, or commercially exploit Hubb Serve proprietary materials.

9. Third-Party Content and External Links

Hubb Serve is designed in part to connect visitors with information and resources available elsewhere on the Internet.

The website may contain links to:

social media platforms;
creator websites;
hobbyist websites;
online retailers;
manufacturers;
clubs and organizations;
classes and instructional providers;
sports organizations;
service providers;
marketplaces;
affiliate partners; and
other third-party resources.

Hubb Serve does not own or control most third-party websites or services.

Unless expressly stated otherwise, the presence of a link does not mean Hubb Serve owns, operates, sponsors, guarantees, certifies, or endorses the third party.

Third-party websites have their own terms, privacy practices, prices, policies, security practices, and business practices.

You are responsible for reviewing those terms before using a third-party website or making a purchase.

10. Affiliate Links and Compensation Disclosure

Some links on Hubb Serve may be affiliate links.

If you follow an affiliate link and make a qualifying purchase or complete another qualifying action, Hubb Serve or a participating content creator or hobbyist may receive a commission or other compensation.

Unless otherwise stated, using an affiliate link does not increase the price you pay.

Affiliate relationships do not guarantee the quality, safety, suitability, availability, or performance of a product or service.

Where required, affiliate or sponsored relationships will be disclosed in accordance with applicable advertising and endorsement requirements.

Users, creators, and members who publish affiliate or sponsored content through Hubb Serve are responsible for complying with applicable advertising disclosure requirements.

11. Product and Service Recommendations

Hubb Serve may provide information about products, equipment, supplies, training materials, classes, services, or other resources that may be useful for a hobby, activity, or sport.

Recommendations are provided for informational purposes and may reflect personal experiences, user submissions, research, affiliate relationships, or other sources.

Hubb Serve does not guarantee that a recommended product or service:

is appropriate for every person;
will produce a particular result;
will remain available;
will remain at a particular price;
meets every safety requirement applicable to a user's circumstances; or
will perform as described by the manufacturer, seller, service provider, creator, or reviewer.

Users should independently evaluate products and services before purchasing or using them.

Parents and guardians are responsible for evaluating whether products, activities, equipment, classes, or services are appropriate for their children.

12. Information About Sports, Hobbies, Activities, and Projects

Instructions, tutorials, recommendations, or demonstrations available through Hubb Serve or linked third-party websites are not substitutes for appropriate professional training, supervision, manufacturer instructions, safety equipment, or professional advice.

13. No Professional Advice

Unless expressly stated otherwise, Hubb Serve does not provide medical, legal, financial, tax, engineering, safety, coaching, or other licensed professional advice.

Information appearing on Hubb Serve should not be relied upon as a substitute for advice from an appropriately qualified professional.

14. Member Businesses, Services, and Transactions

Some members or third parties appearing on Hubb Serve may offer products or services.

Unless Hubb Serve expressly identifies itself as the seller or service provider, any transaction between you and a third party is between you and that third party.

Hubb Serve is not responsible for disputes involving third-party:

purchases;
payments;
refunds;
warranties;
appointments;
deliveries;
service quality;
representations;
contracts; or
business practices.

15. Paid Hubb Serve Services

When separate written terms apply to a paid service, those specific terms control in the event of a conflict concerning that service.

Hubb Serve may change future service offerings and pricing at any time.

Pricing changes will not retroactively alter amounts already paid unless otherwise agreed.

16. Content Creation and Managed Profile Services

Hubb Serve may assist members with creating or managing websites, profiles, social media content, promotional materials, graphics, descriptions, recommendations, or other digital content.

Customers remain responsible for reviewing and approving content created on their behalf unless otherwise agreed in writing.

Customers are responsible for ensuring that information they provide to Hubb Serve is accurate and that they possess the necessary rights to any images, videos, logos, trademarks, text, music, or other materials supplied for use.

Hubb Serve does not guarantee any particular:

number of followers;
website visitors;
social media engagement;
search engine ranking;
sales;
affiliate revenue;
sponsorship;
audience growth; or
other business or content-creation result.

17. Advertising, Sponsorships, and Promotional Content

Hubb Serve may display advertising, sponsorships, paid placements, affiliate content, featured profiles, or promotional materials.

Commercial relationships may influence which products, services, profiles, or content receive additional visibility.

Where disclosure is legally required, Hubb Serve will seek to identify sponsored or affiliate relationships appropriately.

A paid placement or commercial relationship does not constitute a guarantee of the advertiser, product, service, creator, or organization.

18. Accuracy and Availability of Information

Hubb Serve attempts to provide useful and accurate information but cannot guarantee that all information available through the website is complete, current, or error-free.

Information supplied by users, businesses, creators, manufacturers, retailers, social media platforms, and other third parties may change without notice.

Prices, product availability, schedules, program requirements, sports rules, equipment specifications, links, and other information should be verified with the applicable provider before relying upon them.

19. Privacy

Your use of Hubb Serve is also governed by the Hubb Serve LLC Privacy Policy, which explains how Hubb Serve collects, uses, stores, and protects personal information.

The Privacy Policy is incorporated into these Terms by reference.

Where these Terms and the Privacy Policy address different subjects, both documents apply.

20. Copyright Complaints and Intellectual Property Notices

Hubb Serve respects the intellectual property rights of others.

If you believe material appearing on Hubb Serve infringes your copyright or other intellectual property rights, you may submit a written notice to Hubb Serve identifying:

the copyrighted work or intellectual property involved;
the material you believe infringes your rights;
where the material appears on Hubb Serve;
your contact information;
a statement explaining your good-faith belief that the disputed use is unauthorized; and
any additional information required by applicable law.

Hubb Serve may remove or restrict access to material while a complaint is reviewed.

Repeated intellectual property violations may result in account termination.

Formal copyright notices should be sent to the contact identified in the Contact Us section.

21. Monitoring and Content Moderation

Hubb Serve is not required to monitor every submission or external link before publication.

However, Hubb Serve reserves the right to review, moderate, edit, restrict, reject, disable, or remove content or links when Hubb Serve reasonably determines that doing so is appropriate for:

enforcing these Terms;
complying with law;
addressing intellectual property complaints;
protecting children;
protecting users;
preventing fraud or abuse;
responding to safety concerns;
maintaining community standards; or
protecting Hubb Serve's systems or reputation.

Hubb Serve does not guarantee that inappropriate material will always be identified immediately.

Users are encouraged to report suspected violations.

22. Suspension and Termination

Hubb Serve may suspend, restrict, or terminate an account, profile, community membership, listing, or access to services if Hubb Serve reasonably believes that a user:

violated these Terms;
violated applicable law;
provided fraudulent or materially inaccurate information;
infringed another person's rights;
created a safety concern;
misused the platform;
failed to pay amounts owed under a paid service agreement; or
engaged in activity that could reasonably harm Hubb Serve, its users, or third parties.

Where appropriate, Hubb Serve may remove individual content rather than terminate an account.

Users may stop using Hubb Serve at any time.

Termination does not eliminate obligations that arose before termination.

23. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, HUBB SERVE AND ITS WEBSITE, CONTENT, COMMUNITY FEATURES, DIRECTORIES, RECOMMENDATIONS, LINKS, PRODUCTS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

HUBB SERVE DOES NOT MAKE WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE OPERATION, AVAILABILITY, ACCURACY, RELIABILITY, SECURITY, FITNESS, MERCHANTABILITY, NON-INFRINGEMENT, OR SUITABILITY OF THE WEBSITE OR CONTENT.

HUBB SERVE DOES NOT WARRANT THAT:

THE WEBSITE WILL ALWAYS BE AVAILABLE OR ERROR-FREE;
DEFECTS WILL ALWAYS BE CORRECTED;
THIRD-PARTY LINKS WILL REMAIN ACTIVE;
INFORMATION PROVIDED BY USERS OR THIRD PARTIES WILL ALWAYS BE ACCURATE;
PRODUCTS OR SERVICES WILL MEET YOUR EXPECTATIONS; OR
THE WEBSITE OR ITS SERVERS WILL BE FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

24. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HUBB SERVE LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO:

YOUR USE OR INABILITY TO USE HUBB SERVE;
USER-GENERATED CONTENT;
THIRD-PARTY WEBSITES;
THIRD-PARTY PRODUCTS OR SERVICES;
COMMUNITY INTERACTIONS;
LOSS OF DATA;
BUSINESS INTERRUPTION;
LOST PROFITS;
PERSONAL DECISIONS BASED UPON CONTENT;
UNAUTHORIZED ACCESS TO AN ACCOUNT; OR
OTHER MATTERS RELATED TO YOUR USE OF THE WEBSITE.

Where applicable law does not permit a limitation or exclusion of liability, Hubb Serve's liability will be limited to the maximum extent permitted by law.

Nothing in these Terms excludes liability that legally cannot be excluded.

25. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Hubb Serve LLC and its owners, officers, employees, contractors, agents, and affiliates from claims, losses, liabilities, damages, expenses, and reasonable legal costs arising from or relating to:

your violation of these Terms;
your unlawful use of Hubb Serve;
content you submit;
your infringement of another person's rights;
your products, services, representations, or business activities;
your interaction with other users; or
your violation of applicable law.

26. Electronic Communications

When you provide an email address or other electronic contact information to Hubb Serve, you agree that Hubb Serve may provide account notices, service communications, policy notices, confirmations, and other permitted communications electronically.

Marketing email and text-message communications are subject to applicable consent and opt-out requirements.

Where text messaging is offered, message and data rates may apply.

Consent to receive marketing communications is not a condition of making a purchase unless expressly permitted by law.

27. Feedback and Suggestions

If you voluntarily submit ideas, suggestions, comments, feature requests, reviews, or other feedback about Hubb Serve, you authorize Hubb Serve to use that feedback to improve, develop, operate, and promote its services without compensation or obligation to you.

This provision does not transfer ownership of unrelated copyrighted materials or personal content merely because you communicate with Hubb Serve.

28. Security

Users may not attempt to probe, scan, test, bypass, compromise, or interfere with the security of Hubb Serve systems.

Hubb Serve may use technical, administrative, manual, or automated measures to detect or prevent suspicious activity, fraud, abuse, unauthorized access, scraping, malicious automation, or other security threats.

No Internet-based service can guarantee absolute security.

Users are responsible for taking reasonable measures to secure their own accounts, devices, and passwords.

29. Force Majeure

Hubb Serve will not be responsible for delays, interruptions, or failures caused by circumstances reasonably outside its control, including natural disasters, severe weather, fires, acts of government, telecommunications outages, Internet failures, hosting failures, cyberattacks, labor disruptions, epidemics, pandemics, war, terrorism, or failures of third-party platforms or service providers.

30. Governing Law

These Terms and disputes relating to Hubb Serve will be governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles, except where applicable federal law or another law that cannot legally be waived controls.

Unless another dispute-resolution procedure has been agreed to in writing or applicable law requires otherwise, legal proceedings relating to these Terms shall be brought in a court of competent jurisdiction in New Hampshire.

31. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

To the extent legally permitted, the invalid provision may be interpreted or modified as necessary to most closely reflect its intended purpose.

32. No Waiver

Hubb Serve's failure to enforce any provision of these Terms does not waive Hubb Serve's right to enforce that provision or any other provision later.

33. Assignment

You may not assign or transfer your rights or obligations under these Terms without Hubb Serve's written permission.

Hubb Serve may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, change in control, or transfer of the Hubb Serve business.

34. Changes to These Terms

Hubb Serve may revise these Terms periodically to reflect changes in:

services;
website functionality;
business practices;
technology;
legal requirements;
community standards; or
security practices.

When material changes are made, Hubb Serve will update the Last Updated date and may provide additional notice when appropriate.

Your continued use of Hubb Serve after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

35. Entire Agreement

These Terms, the Hubb Serve Privacy Policy, and any additional written terms that apply to particular products, memberships, services, or features constitute the agreement between you and Hubb Serve concerning your use of those services.

Separate service agreements, statements of work, affiliate agreements, advertising agreements, or membership agreements may contain additional terms.

If a specific written agreement conflicts with these general Terms regarding a service covered by that agreement, the more specific written agreement will control for that service.
